South Carolina has set the Blood Alcohol Content (BAC) levels at .08% for adult drivers of passenger cars. South Carolina considers you to have agreed to the BAC tests if you are operating a motorized vehicle on South Carolina roads. Penalties


Your first DUI offense with a BAC under .10% will result in 48 hours to 30 days of jail time or 48 hours of community service. Your license will be suspended for 6 months and you will be charged a $400.00 fine. With a BAC of .10% to .16% you will have 72 hours to 30 days of jail time or 72 hours of community service. Your license will be suspended for 6 months and charged a $500.00 fine. With a BAC above .16% you will serve 30 days to 60 days of jail time or 30 days of public service employment. Your license will be suspended for 6 months and you will pay $1,000.00 in fines.

Your second DUI offense with a BAC under .10% will result in 5 days to one year of jail time. Your license will be suspended for 1 year and you will be charged $2,100.00 to $5,100.00 in fines. With a BAC of .10% to .16% you will have 30 days to 2 years of jail time. Your license will be suspended for one year and charged $2,500.00 to $5,500.00 in fines. With a BAC above .16% you will serve 90 days to 3 years of jail. Your license will be suspended for 1 year and you will pay $3,500.0 to $6,500.00 in fines. Multiple convictions may also result in the mandatory installation of the Ignition Interlock Device (IID) and participation in an alcohol treatment program. Your name will also be released to the public which may hurt your chances of continued employment.

Your third DUI offense with a BAC under .10% will result in 60 days to 3 years of jail time. Your license will be suspended for 2 years and you will be charged $3,800.00 to $6,300.00 in fines. With a BAC of .10% to .16% you will have 90 days to 4 years of jail time. Your license will be suspended for 2 years and charged $5,000.00 to $7,500.00 in fines. With a BAC above .16% you will serve 60 days to 5 years of jail. Your license will be suspended for 2 years and you will pay $7,500.0 to $10,000.00 in fines. Multiple convictions may also result in the mandatory installation of the Ignition Interlock Device (IID) and participation in an alcohol treatment program. Your name will also be released to the public which may hurt your chances of continued employment and your license may also be permanently revoked.

Your fourth DUI offense with a BAC under .10% will result in 1 to 5 years of jail time. Your license will be permanently suspended. With a BAC of .10% to .16% you will have 2 to 6 years of jail time. Your license will be permanently suspended. With a BAC above .16% you will serve 3 to 7 years of jail. Your license will be permanently suspended.
