Kentucky General Insurance Laws

Under Kentucky law, insurance companies may exclude a driver in your household from inclusion on your auto insurance policy.  In fact, the auto insurance company may make this request for persons with a poor driving history which pose a higher risk.  A college student who lives away from home and does not have access to a vehicle may be excluded.  If a driver is excluded from the policy, they have no liability coverage but you still have the liability exposure if they drive one of your vehicles and get in an accident. All exclusions must be stated in the exclusion section of your policy with the list of all the situations your insurance company will not cover.

Some insurance companies will give you better rates if you insure for more than the state mandatory minimums.  Lack of prior insurance coverage due to never owning a car cannot be held against you as long as you have never violated Kentucky’s mandatory insurance laws. 

The state of Kentucky allows insurance companies to check your credit history when they set your premiums and determine whether they will insure you.  The company may ask you to explain any bankruptcies, judgments, or credit problems.  Insurance companies will not use your credit history alone to determine the insurability or set the premium rates for their clientele.  The insurance company will also use other criteria such as your driving record, age, type of vehicle you drive and the area where you live to determine your premium rates.

Kentucky is a Choice No Fault state which means you can choose to use the No Fault system or you can choose to use the Tort system for mandatory liability insurance coverage.  Under the Tort system you can be personally sued for injuries, deaths, and damages beyond the amounts your insurance policy covers.  Under the No Fault system, you can only be sued for severe injury and death which is determined by the courts.  The No Fault insurance will pay up to $10,000.00 for lost wages, medical expenses, and replacement services.  You may choose to purchase higher coverage for your No Fault policy. 

The average insurance premium in Kentucky averages about $739.00 and has the 28th most expensive auto insurance premiums in the nation as of 2006.  The lowest premiums available in Kentucky are offered to the 68 year old male widower by United Services Automobile Association with a premium price of $598.00 for the annual premium.  This company also offers the lowest rates across all three categories.  On the other hand, the 40 year old male with a wife and teenage daughter receives the highest premium rates with a $26,222.00 annual premium accessed by the Sagamore Insurance Company.  This company has the highest premium rates across all three categories.  There are 99 major insurance companies which have met the qualifications to sell auto insurance in the state of Kentucky.
